Terms and Conditions

Our Service

• We aim to provide an efficient and effortless service designed to ensure that our client’s and their clients’ needs are paramount
• This service is available 24/7 & Nationwide
• Upon successful registration, all instructing Agents will receive job advertisement via our unique SMS and E-mail notification system

Our Terms

• Agents are required to use our Police Station Proforma ONLY
• It is the Agents responsibility to ensure that they have access to our Proforma and the Police Station Pack provided on acceptance of all police station requests
• Upon accepting an instruction, the Agent must liaise with the officer in the case Custody and inform them of their eta
• Agents are expected to carry all relevant Identification documents on them when attending the Police Station
• Agents are expected to notify the Solicitor via the On-line portal of their Arrival and Departure at the Police Station
• It is the Agents responsibility to get on-line declaration completed and signed
• Financial details Legal Aid purposes should be recorded on the Proforma
• Results should be communicated to the Solicitors via SMS or Email service within a reasonable amount of time or no later then before 08:30am the following day
• Agents must ensure that all Attendance notes and Police supporting Docs including Signed On-Line declaration will be uploaded onto the Solicitors individual portal within 24 hours of the attendance

Disbursements and Time Recordings

• All times should be recorded
• All travel disbursements exceeding £10 should be provided with a receipt when documents are uploaded
• Mileage to be charged at a rate of £0.45 per mile.
• Agents will be paid £80 per Police Station Attendance, irrespective of how many interviews on the day (unless further fees have been negotiated with the Instructing Solicitors)
• This will increase to £90 for matters covered between 00:00 hours and 06:00 hours.
• Payment will aimed to be made within 28 days of Attendance
• In Custody will chase Solicitors for late payments of invoices
• Agents will be paid when In Custody is paid, payments will not be made prior to payment being received
• All payments can be monitored on the Agents individual portal
• All Agents are self-employed and therefore responsible for their own tax and National Insurance

1. In Custody is not a Solicitors Practice or other law firm.
2. In Custody whether by itself, servants, agents or employees will always endeavour to give the ‘best advice’ to clients of Solicitors Firm’s at the Police Station but this advice is always dependent upon a number of factors often beyond its control and therefore the quality of advice given cannot be guaranteed or liability accepted whatsoever.
3. Instructing Solicitor Firm’s shall indemnify and keep indemnified In Custody its servants, agents or employees against any liability, losses, damages, penalties, fines, costs and expenses (including legal costs) suffered or incurred and arising out of its attendance and obligations at the Police Station on that Firm’s behalf.
4. Instruction to attend the Police Station will be taken as acceptance of these terms.
5. In Custody are not liable to the instructing solicitors for the following:
   i): Loss of profits
   ii): Loss to solicitors or business
   iii): agreements and contracts
   iv): Goodwill

By accepting these terms and conditions you are declaring that you have the relevant qualifications and PIN to act.

These Terms and Conditions will be imposed and supercede all before them.
