Service Provided

  • We aim to provide an efficient and effortless service designed to ensure that our client’s and their clients’ needs are paramount
  • This service is available 24/7 & Nationwide
  • We will ensure all our Agents are qualified and allowed to accept instructions to represent your client
  • All instructing Solicitors will receive confirmation of the Agents attendance and conclusion via our E-mail notification system
  • We will ensure that all attendance notes and supporting documents (including Signed On-Line declarations) will be uploaded onto the Solicitors individual portal within 24 hours of the attendance
  • Solicitors will be notified via SMS or E-mail once this has been uploaded
  • Each individual instructing Solicitor will have their own login details

Our Terms

  • It is the Solicitors responsibility to access the documents once they have been uploaded. In Custody will not send out reminders for this
  • Should Solicitors wish for hard copies to be submitted then they can opt-in to this service at an additional cost to be agreed on point of request
  • A fixed fee of £110 between 6am and midnight, if the invoice is settled within 14 days of the attendance then the Solicitors will recieve a reduction of £10
  • A fixed fee of £120 between midnight and 6am, if the invoice is settled within 14 days of the attendance then the Solicitors will receive a reduction of £10
  • This is a one off fee & will not cover attendances in relation to clients returning to answer bail, identification procedures and re-interviews
  • Payment is due within 14 days of the attendance to eligible for the reduced rate or a maximum of 30 days as per the Criminal Contract Clause 3.3
  • A late payment fee of 10% of the total invoice will be incurred for all payments made after the statutory 30 day requirement
  • Solicitors will also be subjected to paragraph 5.8, Abortive Attendances, Chapter 5 Police Station and Assistance:
  • Where an Agent responds to a request for advice but, for circumstances out of the Agent's control, no interview takes place, a fixed fee is still claimable. A note should be kept on the file detailing the particular circumstances (Point of Principle DS4).

Examples

  1. Agent attends for pre-arranged interview but client does not attend.
  2. Agent attends the police station to find that the client has already been released.
  3. Agent is en-route to police station and before arrival is informed that his services are no longer required.
  • Instructing Solicitors must complete the mandatory requirements field on the submission form when instructing Agents
  • A DSCC number must be provided prior to attendance. In the event that one is not provided then it is the responsibility of the Solicitors and not the Agent to log the case with the DSCC
  • Should instructing Solicitors cease trading then In Custody reserve the right to reclaim money outstanding to the Agent prior to the Solicitor settling the invoice

Disclaimer

  1. In Custody is not a Solicitors Practice or other law firm.
  2. In Custody whether by itself, servants, agents or employees will always endeavour to give the ‘best advice’ to clients of Solicitors Firm’s at the Police Station but this advice is always dependent upon a number of factors often beyond its control and therefore the quality of advice given cannot be guaranteed or liability accepted whatsoever.
  3. Instructing Solicitor Firm’s shall indemnify and keep indemnified In Custody its servants, agents or employees against any liability, losses, damages, penalties, fines, costs and expenses (including legal costs) suffered or incurred and arising out of its attendance and obligations at the Police Station on that Firm’s behalf.
  4. Instruction to attend the Police Station will be taken as acceptance of these terms.
  5. In Custody are not liable to the instructing solicitors for the following:
    i): Loss of profits
    ii): Loss to solicitors or business
    iii): agreements and contracts
    iv): Goodwill

By accepting our terms and conditions, you confirm that you have read them, understood them and accepted the contents within.

These Terms and Conditions will be imposed and super-cede all before them.
